Terms And Conditions

Introduction

Source I.T. Inc. (“Source I.T.”) provides an online information, communication, and ordering service (“the Website”) accessible only to registered customers and approved guests (“Users”). By accessing the Website and ordering through the Website, Users agree to comply with these legally binding Terms and Conditions.

Source I.T. reserves the right to modify this agreement at any time, with changes effective immediately upon posting. Users are encouraged to periodically review these Terms and Conditions.

Privacy and Data Use

Source I.T. values your privacy. By using the Website, Users consent to the collection, use, and storage of their personal and transactional data as described in our Privacy Policy. The Website complies with applicable data protection regulations, including GDPR and CCPA. Users have the right to access, correct, or request deletion of their data by contacting [email protected].

User Eligibility

  1. Be at least 18 years of age or have parental/guardian consent.
  2. Register with accurate and truthful information.
  3. Ensure compliance with all applicable laws and regulations when accessing or using the Website.

User Responsibilities

  1. Users may not share their proprietary login credentials with unauthorized parties without prior written permission from Source I.T.
  2. Access to the Website is granted solely for reviewing inventory and making legitimate purchases.
  3. Users are prohibited from attempting to:
    • Modify, reverse engineer, decompile, or disassemble Website content, software, or design.
    • Circumvent Website security features.
  4. Any breach of these responsibilities may result in immediate termination of access and legal proceedings.

Orders

  1. Orders are processed in real-time but inventory availability is not guaranteed.
  2. Prices are subject to change without prior notice based on market conditions.
  3. Users must complete orders promptly to ensure availability.
  4. Orders are final once shipped and are subject to our return policies and potential restocking fees.
  5. Cancellations may be processed provided that the order has not yet been shipped.

Substitute Parts

Source I.T. reserves the right to substitute parts purchased with parts of the same or better form, fit, and function as defined by the manufacturer’s specifications or substitution guidelines. Substituted parts will meet or exceed the functional equivalence of the originally ordered part to ensure compatibility and performance.

  1. Manufacturer-Approved Substitutes: If the manufacturer provides an equivalent or upgraded part as a substitute, Source I.T. may fulfill the order with the manufacturer-approved substitute.
  2. User Notification: Users will be notified if a substitution is made prior to shipping, where deemed necessary.
  3. Warranty: Substituted parts are covered under the same warranty as the originally ordered part.
  4. Exclusions: Users may not reject substituted parts solely due to cosmetic differences, provided the functional specifications are met.

This clause ensures flexibility in fulfilling orders while maintaining the delivery, quality, and performance expected by the User.

Courier and Shipping Policy

  1. Shipping costs are calculated based on dimensional weight and the delivery service selected.
  2. Source I.T. does not guarantee on-time delivery due to third-party carrier limitations.
  3. Source I.T. is NOT responsible for errors, delays, damage, or losses caused by third-party couriers, including but not limited to FedEx, UPS, Canada Post, and DHL. Once an order has been handed over to the courier, all liability for shipping-related issues rests with the courier service. Any disputes regarding lost, delayed, or damaged shipments must be addressed directly with the courier.
  4. Users are responsible for customs, duties, and claims on international orders. Losses incurred through Canada Post shipments are not reimbursed through Source I.T. These issues must be taken up with Canada Post.

Third-Party Billing

Users authorizing third-party shipping are responsible for validating account details and are liable for freight costs if the designated carrier rejects billing.

Free Gifts

Any free gifts offered with purchases are only available while supplies last. Source I.T. does not guarantee availability of free gifts and reserves the right to substitute or discontinue them at any time without prior notice.

Credit Card Chargebacks

  1. Users are expected to resolve disputes directly with Source I.T. prior to initiating any credit card chargebacks.
  2. Unauthorized or unjustified chargebacks will be considered a violation of these Terms and Conditions.
  3. In the event of an unjustified chargeback, Source I.T. reserves the right to:
    • Suspend or terminate the User’s account.
    • Reissue a chargeback invoice to the customer.
    • Take collections and legal action to recover owed amounts, including chargeback fees and associated costs.
    • Apply a minimum chargeback fee of $60.00 for time and costs associated with processing chargeback invoices.
  4. If a chargeback is determined to be valid following review, Source I.T. will work with the User to resolve the matter in good faith.

Returns and RMA Policy

  1. Return Merchandise Authorization (RMA) numbers are required for all returns. NO EXCEPTIONS. Requests must include part details, failure descriptions, and serial numbers.
  2. RMAs must be requested and initiated within 30 days of the invoice date and received within 30 days of the issuance date of the RMA number.
  3. Returns are processed for credit only; no exchanges will be offered.
  4. Returned items must be in original packaging, and a restocking fee of $25 or 25% (whichever is greater) applies to good parts being returned.
  5. Source I.T. will test all claimed defective returns upon receipt and reserves the right to apply a good material return fee ($25 or 25% whichever is greater) to parts claimed DOA that were not found to be defective.
  6. Source I.T. will not be responsible for return shipping charges or be held responsible for taxes charged on returns where the paperwork was incorrectly completed. All paper work and customs forms should be labeled as Returned product and be Tax free.

Duties, Tariffs, and Taxes

All goods supplied by Source I.T. Inc., including new, refurbished, and replacement IT parts, may be subject to customs duties, tariffs, import taxes, and related charges as determined by the applicable authorities. While certain items may qualify for preferential treatment under the United States–Mexico–Canada Agreement (USMCA), Source I.T. Inc. makes no representation or guarantee regarding eligibility or tariff classification.

The purchaser is solely responsible for all duties, tariffs, taxes, fees, and compliance with applicable import regulations. Source I.T. Inc. shall not be liable for delays, additional costs, penalties, or other consequences arising from customs clearance, misclassification, or denial of preferential tariff treatment.

By placing an order, the purchaser agrees to indemnify and hold harmless Source I.T. Inc. against any claims, liabilities, or expenses relating to the assessment or collection of such duties and taxes.

Liability and Disclaimers

  1. The Website is provided “as is,” and Source I.T. disclaims all implied warranties, including but not limited to merchantability, non-infringement, and fitness for a particular purpose.
  2. Source I.T. is not liable for damages resulting from use of the Website, including loss of data or profits.
  3. Users are responsible for maintaining their systems’ security against potential viruses or malware.

Dispute Resolution

Any disputes arising from these Terms and Conditions or use of the Website will be governed by the laws of Ontario, Canada, and resolved in Ontario courts. Users consent to this jurisdiction as the exclusive forum for disputes.

Force Majeure

Source I.T. is not liable for delays or failures in performance caused by events beyond its reasonable control, including but not limited to natural disasters, strikes, system outages, or supplier disruptions.

Termination of Access

Source I.T. reserves the right to revoke Website access without notice for violations of these Terms and Conditions or other security concerns.

Modifications and Notifications

  1. Source I.T. may update these Terms and Conditions at its discretion.
  2. Notification of significant changes will be provided via email or Website banners.
  3. Continued use of the Website constitutes acceptance of the updated Terms.
